Legal Principle Dept: Gallo, 65, recently launched an appeal of a decision rendered in May 2010 by the Immigration and Refugee Board, which ruled he could be deported to his native Italy despite having lived in Canada for more than five decades. He recently filed his second appeal of the IRB's decision through the Federal Court of Canada. The appeal was filed on the same day Revenue Canada issued a writ of seizure on two properties owned by Gallo's 32-yearold son Anthony following an investigation that alleges the younger Gallo and his wife owe more than $488,000 in taxes on undeclared revenue, according to Montreal Gazette. The house was sold on Dec. 14, 2010, a week after Moreno Gallo lost his first appeal of the IRB's decision. But on Sept. 27, Gallo filed for a judicial review of his case based on "a recent discovery of the legal principle of domicile that would bar Immigration Canada from deporting Gallo ." Despite being ordered deported more than a year ago, Moreno Gallo, a man alleged by police to be an influential figure in the Mafia, claims to have found a loophole that would allow him to stay.
