Quebec Court Dept: Villanueva, 24, was acquitted, along with four others, of armed robbery and possession of a fake gun, after Judge Louise Bourdeau ruled Montreal police didn't have reasonable grounds to detain the group on June 18, 2008, according to Montreal Gazette. The decision could help Villanueva's struggle to stay in Canada after losing his appeal this year of an Immigration and Refugee Board order to return to his native Honduras. The IRB ruled that Villanueva, who has been stripped of his permanent residence status, must be deported because of his alleged ties to street gangs, his past record and his pending criminal charges and a rare and relieved smile lit up Lillian Madrid Villanueva's face Friday as her son, Dany, finally seemed to catch his first break in years and Montreal police got a dressing down by a Quebec Court judge for overstepping their powers. Even though police found the stolen gold chain and imitation gun inside the car, the judge said such evidence couldn't be accepted because police violated rights in obtaining it.
