Clear And Convincing Evidence Dept: In a decision posted this week, the Federal Court of Canada declined the refugee board s request because it has not demonstrated with clear and convincing evidence that it will suffer irreparable harm as a result, according to The Star. The board, Canada s largest independent tribunal, argued that it would suffer reputational harm, including a loss of public confidence in the IRB as an institution and the Immigration and Refugee Board of Canada has failed in its bid to stop a government investigation into 13 of its appointments. The 13 investigations by the Public Service Commission were triggered by an Auditor General report in 2009 that found some of the board s hiring and appointments were not based on merits. As
